These Terms of Service ("Terms") govern your access to and use of the Gem Heaven mobile application and related services (collectively, the "Service") operated by Gem Heaven ("we", "us", or "our"). By downloading or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1.Eligibility
You must be at least 13 years old to use Gem Heaven. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By creating an account you represent that all information you provide is accurate and complete.
2.Account Registration
You may register using an email address, Google account, or Apple ID. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at contact@codematics.co if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that violate these Terms, remain inactive for an extended period, or are found to be fraudulent.
3.The Service — What We Provide
3.1 AI Identification
Gem Heaven uses artificial intelligence to identify rocks, minerals, and gemstones from photographs. Identification results are provided for informational and educational purposes only. They do not constitute a professional gemological appraisal, certification, or guarantee of authenticity. For formal valuation or authentication, we recommend engaging a certified gemologist or recognised laboratory such as GIA, SSEF, or GIT.
3.2 Market Valuation
The valuation feature generates AI-estimated market value ranges based on publicly available data and the details you provide (size, weight, condition). These estimates are indicative only and should not be relied upon as a basis for significant financial decisions. Actual market prices vary and Gem Heaven accepts no liability for losses arising from reliance on valuation estimates.
3.3 Portfolio & Collection
You may save scan results to your personal portfolio. You are responsible for the accuracy of any details you add or edit manually.
3.4 AI Specialist Chat
The chat feature provides general gemological information. The AI will not provide valuations of your specific stones through the chat function and will redirect such queries to the Valuation feature. Chat responses are AI-generated and should not be treated as certified professional advice.
3.5 Marketplace
The Marketplace allows registered users to list, buy, and sell gemstones and minerals. Gem Heaven acts as a platform intermediary only. We are not a party to any transaction between buyers and sellers and make no representations regarding the quality, safety, legality, or authenticity of any listed item.
By listing an item you represent that:
- You own the item or have the legal right to sell it
- The item description and photographs are accurate and not misleading
- The item is not counterfeit, stolen, or subject to export restrictions
- You will fulfil the order promptly upon payment confirmation
4.Marketplace Rules
4.1 Listings
Each listing costs 5 Gems (credits). Listings must accurately describe the item, including any known treatments, inclusions, or damage. Prohibited listings include: counterfeit or misrepresented items, items that violate any law or export control, stolen property, and any item not related to rocks, minerals, or gemstones.
We reserve the right to remove any listing at our sole discretion, including through the admin pause mechanism, and to ban repeat offenders.
4.2 Payments and Escrow
Payments are processed by Stripe. When a buyer completes a purchase, funds are held in escrow on the platform's Stripe account. Funds are released to the seller only after the buyer confirms receipt of the item or after the automatic release period expires (14 days from the seller marking the item as shipped).
For sellers in regions where Stripe Connect is not available, payouts are processed manually by our team in the seller's local currency at the exchange rate locked at the time of sale.
4.3 Cancellations and Refunds
Buyers may cancel a transaction within 3 hours of purchase. A cancellation fee of 5 Gems applies to both buyer-initiated cancellations and seller-initiated cancellations (seller cannot fulfil). Stripe refunds are processed to the original payment method. Processing times vary by card issuer (typically 5-10 business days).
Sellers who cancel 3 or more transactions within any 30-day period will be temporarily blocked from creating new listings.
4.4 Disputes
If a buyer believes an item was not delivered, was significantly not as described, or was damaged in transit, they may open a dispute through the transaction screen. Our team will review the dispute and issue a decision (refund to buyer or release to seller) within a reasonable timeframe. Both parties agree to cooperate with our dispute review process and to provide evidence promptly.
4.5 Prohibited Conduct
You must not:
- Attempt to conduct transactions outside the platform to avoid fees
- Share contact details, payment app handles, or external links in chat to solicit off-platform payment
- Manipulate listings, bids, or reviews
- Use the Service for money laundering or any fraudulent purpose
- Create multiple accounts to circumvent bans or restrictions
5.Credits and Subscriptions
5.1 Gem Credits
Gem credits ("Gems") are the in-app currency used to access premium features. New users receive 15 Gems on account creation at no charge. Gems are non-transferable, have no cash value, and cannot be exchanged for money. Unused credits do not expire but may be forfeited if your account is terminated for a Terms violation.
5.2 Credit Packs
One-time credit packs are available for purchase through Apple App Store or Google Play. All purchases are final and non-refundable except as required by applicable law or the policies of Apple or Google.
5.3 Subscriptions
Subscriptions are available on a weekly or annual basis. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings. We do not process subscription cancellations directly.
Price changes to subscriptions will be communicated with reasonable notice. Continued use after a price change constitutes acceptance of the new price.
6.User Content
You retain ownership of content you submit to the Service (photographs, listing descriptions, messages). By submitting content you grant us a worldwide, royalty-free, non-exclusive licence to use, store, and display that content solely for the purpose of operating and improving the Service.
You are solely responsible for the content you post. You must not post content that is false, misleading, defamatory, obscene, or that infringes any third-party intellectual property rights.
7.Intellectual Property
All software, design, trademarks, and content created by Gem Heaven in connection with Gem Heaven are our exclusive property or licensed to us. You may not copy, reverse-engineer, decompile, or create derivative works from the Service. The Gem Heaven name and logo are trademarks of Gem Heaven.
8.Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI IDENTIFICATION OR VALUATION RESULTS WILL BE ACCURATE.
9.Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GEM HEAVEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING RELIANCE ON AI IDENTIFICATION OR VALUATION RESULTS, MARKETPLACE TRANSACTIONS, OR ANY LOSS OF DATA. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.
10.Governing Law
These Terms are governed by the laws of Pakistan. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Abbottabad, Khyber Pakhtunkhwa, Pakistan, except where applicable consumer protection law requires otherwise.
11.Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
